Niklas Luhmann is widely recognized as one of the most original thinkers in the social sciences today. This major new work further develops the theories of the author by offering a challenging analysis of the relationship between society and the environment. Luhmann extends the concept of "ecology" to refer to any analysis that looks at connections between social systems and the surrounding environment. He traces the development of the notion of "environment" from the medieval idea--which encompasses both human and (...) natural systems--to our modern definition, which separates social systems from the external environment. In Luhmann's thought, human beings form part of the environment, while social systems consist only of communications. Utilizing this distinctive theoretical perspective, Luhmann presents a comprehensive catalog of society's reactions to environmental problems. He investigates the spheres of the economy, law, science, politics, religion, and education to show how these areas relate to environmental issues. Ecological Communication is an important work that critically examines claims central to our society--claims to modernity and rationality. It will be of great importance to scholars and students in sociology, political science, philosophy, anthropology, and law. (shrink)

abstract Even though much research has been devoted to studies of safety, the concept of safety is in itself under‐theorised, especially concerning its relation to epistemic uncertainty. In this paper we propose a conceptual analysis of safety. The paper explores the distinc‐tion between absolute and relative safety, as well as that between objective and subjective safety. Four potential dimensions of safety are discussed, viz. harm, probability, epistemic uncertainty, and control. The first three of these are used in the proposed definition (...) of safety, whereas it is argued that control should not be included in a reasonable definition of safety. It is shown that strictly speaking, an objective safety concept is not attainable. Instead, an intersubjective concept is proposed that brings us as close as possible to an objective concept. Teoriju anticke komedije Hegel neprestano razvija tokom svoje akademske karijere, od ranog spisa o prirodnom pravu, preko Fenomenologije duha do svojih berlinskih predavanja iz estetike. Hegel uvek razmatra komediju u bliskoj vezi sa svojom teorijom tragedije, te otuda u kontekstu politickih, religioznih i filozofsko-istorijskih odredjenja. Imajuci to u vidu, ovaj rad istrazuje Hegelov pojam dramskog zanra komedije u odnosu na duhovno-filozofske kategorije obicajnosti i supstancijalnosti kao kraja klasicne umetnosti i ujedno nastanka moderne subjektivnosti u njenom slobodnom samoodnosenju. Centralno pitanje je, (...) na koji nacin se razvijanje apsolutnog duha reflektuje u domenu estetskog na razvijanje objektivnog duha u sferi drzave i drustva, kao sto je, recimo, u grckoj komediji dovedena do svesti buduca propast svetsko-obicajnog statusa polisa. AimsTo examine attitudes towards physician-assisted suicide (PAS) among physicians in Sweden and compare these with the results from a similar cross-sectional study performed in 2007.ParticipantsA random selection of 250 physicians from each of six specialties (general practice, geriatrics, internal medicine, oncology, surgery and psychiatry) and all 127 palliative care physicians in Sweden were invited to participate in this study.SettingA postal questionnaire commissioned by the Swedish Medical Society in collaboration with Karolinska Institute in Stockholm. ResultsThe total response rate was 59.2%. Slightly (...) fewer than half [47.1% (95% CI 43.7–50.5)] of the respondents from the six specialties accepted PAS, which is significantly more than accepted PAS in the 2007 study [34.9% (95% CI 31.5–38.3)]. Thirty-three percent of respondents were prepared to prescribe the needed drugs. When asked what would happen to the respondent’s own trust in healthcare, a majority [67.1% (95% CI 63.9–70.3)] stated that legalizing PAS would either not influence their own trust in healthcare, or that their trust would increase. This number is an increase compared to the 2007 survey, when just over half [51.9% (95% CI 48.0–55.2)] indicated that their own trust would either not be influenced, or would increase.ConclusionsThe study reveals a shift towards a more accepting attitude concerning PAS among physicians in Sweden. Only a minority of the respondents stated that they were against PAS, and a considerable proportion reported being prepared to prescribe the needed drugs for patient self-administration if PAS were legalized. Self-tracking-technologies can serve as a prominent example of how digital technologies put to test established practices, institutions, and structures of medicine and healthcare. While proponents emphasize the potentials, e.g., for individualized healthcare and new research data, opponents stress the risk that these technologies will reinforce gender-related inequalities. -/- While this has been made clear from—often intersectional—feminist perspectives since the introduction of such technologies, we aim to provide a queer-feminist perspective on self-tracking applications in healthcare by analyzing three concrete cases. In (...) this way, we want to show why such a perspective is helpful in assessing self-tracking technologies and how such a perspective might contribute to a queering of healthcare. -/- After a short introduction to self-tracking in healthcare and the corresponding risks of reproducing gender-related inequalities, we introduce queer bioethics as a methodology to examine structural discrimination and marginalization in bioethical research. We apply this framework in the analysis of three exemplary self-tracking applications from the areas of nutrition/fitness, reproductive health, and mental health. In the subsequent discussion of these results against the backdrop of already existing queer-sensitive technologies, we identify an equal access, a subversive design, an inclusive database, and a diversity-sensitive and discriminatory-critical definition of purposes as well as individualized usage possibilities as first possible starting points for a queering of self-tracking applications. Finally, we draw conclusions, how such a critical perspective on self-tracking applications might also contribute to a queering of the healthcare system at a structural level. (shrink)

Zusammenfassung: Der Beitrag systematisiert, kontextualisiert und evaluiert den eigentumstheoretischen Hintergrund der derzeit breit geführten Debatte um bezahlbaren Wohnraum in deutschen Großstädten. Ausgehend von der These, dass hinter der sogenannten ‚Wohnungskrise‘ eigentlich eine ‚Bodenkrise‘ steht, werden drei zentrale Konflikte um die politische Rahmung des Eigentums an Boden diskutiert: die Frage nach dem Gebrauch, der Verwertung und dem Eigentumsschutz. Dabei werden die normativen Potentiale eines immanenztheoretischen, apriorisch pflichtgebundenen Eigentumsverständnisses für eine zeitgemäße Wohnraum- und Bodenpolitik ausgelotet.

This paper develops an empirically grounded, processual view of corporate social performance (CSP) by analyzing how internal organizational processes affect a firm’s social performance. Based on two case studies, we argue that changes in a firm’s social performance are triggered by continuously reoccurring instances of poor fit between the firm’s routines and its institutional environment. We propose that reactive change processes, initiated by stakeholder critique threatening the organization’s legitimacy, will result in isomorphic type of social performance changes. In comparison, proactive (...) change processes, initiated by slack resources, are more likely to result in nonisomorphic type of social performance changes. Furthermore, we propose that top-down driven processes will result in structural social performance changes in the direction of internationally influential stakeholders’ demands, while bottom-up driven processes will result in output social performance changes in the direction of locally influential stakeholders’ demands. This article argues that Hannah Arendt’s essay “Civil Disobedience” contains a critique of white constitutionalism. A close reading of Arendt’s comments on the failure of Reconstruction to durably found Black citizenship reveals that the anti-Blackness of her account does not consist in ignoring the racialization of constitutional order but, to the contrary, in a dismissal of Black politics due to the limitations of a white constitutional heritage. In “Civil Disobedience,” Arendt thus stood on the edge of an insight that she (...) failed to develop more fully: Black movements had brought to light the limitations that racial domination places on the “augmentation” of America’s founding principles. For Arendt, the notion of the “principle” is meant to mediate the novelty of action with the durability of order. But to the extent that she views American institutions as defined by the “inherited crime” of slavery, feedback across temporal strata—between a principle in past, present, and future—is structurally blocked. The symbolic whiteness of citizenship undermines institutional durability, as it generates a crisis of constitutional authority for all. Tracing the sources behind Arendt’s pessimistic vision, the article demonstrates echoes between her account and the literature on which she relied: Tocqueville; Stanley Elkins; and, possibly, W. E. B. Du Bois. It concludes with a reading of Arendt’s commentary on Reconstruction as the attempt to recover a lost moment of foundation, an unredeemed promise of refounding. (shrink)

Massimiliano Tomba’s Insurgent Universality traces a global history of revolutionary institution-building as ‘theory in action’, pushing radical democracy beyond an ontology of the political. This contribution aims to clarify the place of ‘insurgent institutions’ in Tomba’s work and suggests that an unresolved tension persists between insurgent universality as popular institutions on the one hand, and as a negative dis-ordering on the other. Exploring the promise and limitations of ‘insurgent institutions’ in light of their durability, its first part reads Insurgent Universality (...) alongside Santi Romano, the legal pluralist whose concept of the institution Tomba adopts. Secondly, the article turns to Hannah Arendt’s understanding of authority and Miguel Abensour’s discussion of ‘insurgent institutions’ as two potentially helpful accounts of democratic practice within durational time. Where Tomba remains focused on constellations between moments of rupture, Arendt and Abensour offer a politically generative understanding of durability specific to radical-democratic institutions. La acción de los medios de prensa de construir y representar realidades socioculturales genera --en reiteradas ocasiones-- relaciones desiguales, promoviendo e institucionalizando unas identidades en desmedro de otras. La situación se complejiza cuando se trata de países vecinos, con sus respectivas tradiciones socio-histórico-culturales, pasados comunes y límites bisagra. Bajo este escenario se analizaron las producciones noticiosas de cobertura nacional publicadas en los periódicos de mayor tirada de dos países limítrofes: “El Mercurio” de Chile y “El Comercio” de Perú. De este (...) modo, y por medio de una herramienta metodológica ligada al Análisis Crítico y Complejo del Discurso, esta investigación busca comprender los procesos de construcciones noticiosas y representaciones que los medios de prensa chilenos y peruanos hacen en torno a los “discursos de la diferencia” que se institucionalizan en la relación entre ambas naciones. The action of the press media of constructing and representing socio-cultural realities generates --on numerous occasions-- unequal relationships, which promote and institutionalize certain identities in detriment of others. The situation becomes more complex when it deals with neighboring countries and their corresponding socio-historical-cultural traditions, shared pasts, and “hinge-like” borders. Under this scenario, the production of national news by two nationwide press media of the neighboring countries will be analyzed: “El Mercurio” of Chile and “El Comercio” of Perú. In this manner, and using a methodological tool based on the Critical and Complex Analysis of the Discourse, the main objective of this research is to understand processes of construction of news and representations that the Chilean and Peruvian press make linked to the “discourse of the differences” which have been institutionalized in the relationship between them both. What challenges must a principle of need for prioritisations in health care meet in order to be plausible and practically useful? Some progress in answering this question has recently been made by Hope, Østerdal and Hasman. This article continue their work by suggesting that the characteristic feature of principles of needs is that they are sufficientarian, saying that we have a right to a minimally acceptable or good life or health, but nothing more. Accordingly, principles of needs must answer two (...) distributive questions: when do we have sufficient and how should we prioritise among those who do not yet have a sufficiency? Furthermore, it is argued that Roger Crisp’s theory of need, which combines sufficientarianism with prioritarianism below the threshold of need, is better equipped than alternatives to answer these questions as well as meeting the challenges formulated by Hope, Østerdal and Hasman. However, Crisp’s theory faces two major challenges. First, it has to say something about the currency of distribution: a principle of need must be complemented either with a theory on the human good or a theory about the proper goals of health care. Second, it has to say something about where the threshold should be set. However, any attempt to set a threshold seems morally arbitrary in the light of the sufficientarian idea that those just above the threshold never should be given priority over those just below the threshold. In this paper I argue that it’s impossible for there to be a single universal theory of meaning for a language. First, I will consider some minimal expressiveness requirements a language must meet to be able to express semantic claims. Then I will argue that in order to have a single unified theory of meaning, these expressiveness requirements must be satisfied by a language which the semantic theory itself applies to. That is, we would need a language which can express (...) its own meaning. It has been well-known since Tarski that theories of meaning whose central notion is truth can’t be expressed in a language which they apply to. Here, I develop Quine’s formulation of the Liar Paradox in grammatical terms and use this to extend Tarski’s result to all theories of meaning. This general version of the paradox can be formalised as a special case of the Lawvere Fixed-Point Theorem applied to a categorial grammar. Taken together with the initial arguments, I infer that a universal theory of meaning is impossible and conclude the paper with a brief discussion on what alternatives are available. (shrink)

La pregunta por el alcance y la relevancia de la angustia en la obra escrita de Martin Heidegger es uno de los problemas fundamentales del debate contemporáneo, y no solamente en cuanto a sus declinaciones filosofizantes. En este trabajo se delimita el lugar de ¡a angustia en Ser y Tiempo, centrándose, en un primer momento, en contextualizar la temática al interior del proyecto inconcluso de Ser y Tiempo, para luego introducir la noción de la angustia en tanto apertura distinguida o (...) destacada del Dasein. The question about the extent and relevance of the concept of anxiety inside the written work of Martin Heidegger is one of the fundamental problems not only the p h i l o s o p h i c al declinations of the contemporary debate turn around. In the present article the place of anxiety in Being and Time is delimitated, focusing the discussion, in first place, on locating the thematic in the context of the unconcluded project of Being and Time, followed by the introduction of the notion of anxiety as distinguished or outstanding aperture of the Dasein. This article is about the justifiability of accepting worse cost effectiveness for orphan drugs, that is, treatments for rare diseases, in a publicly financed health care system. Recently, three arguments have been presented that may be used in favour of exceptionally advantageous economic terms for orphan drugs. These arguments share the common feature of all referring to considerations of justice or fairness: the argument of the irrelevance of group size, the argument from the principle of need, and the argument of (...) identifiability. It is argued that all of these arguments fail to support the conclusion that orphan drugs should be subsidized to a larger extent than treatments for common diseases. The argument of the irrelevance fails to distinguish between directly and indirectly relevant considerations of fairness or justice. The recent attempt to revive the moral relevance of identifiability has provided no novel reasons to think that identifiability is morally relevant in itself or due to considerations of fairness and justice. The argument from the principle of need does not fail due to any inherent flaw in the principle as such. Rather, this principle can be interpreted in different ways, and none of these interpretations support exceptionally advantageous terms economically for treating rare diseases specifically. It is concluded that we are awaiting justice based reasons for the preferential treatment of orphan drugs. (shrink)

Die Abschiedsvorlesung von Niklas Luhmann an der Universität Bielfeld 1993 unter dem Titel: "Was ist der Fall?" und "Was steckt dahinter?" - Die zwei Soziologien und die Gesellschaftstheorie.

Jan Patočka opens “The Phenomenology of Afterlife” by indicating that philosophers always tend to focus on questions about the mortality or immortality of the soul when thinking about death, and that he wants to take a different route focusing instead on the phenomenology of the afterlife and the ways the diseased others live in us. And this is what the major bulk of the text focuses on. But as Patočka’s unfinished text is about to end, he leaves us with a (...) peculiar addendum that signals that a return to the more traditional questions – about death as mine – is necessary. In this text, I seek to elucidate what the phenomenology of afterlife brings to the traditional discussion about death as mine (and about my “soul”). One of the more prominent and well-developed modern theories that discuss death as mine is Derek Parfit’s. Thus, the effort in this text is to find out what Patočka’s phenomenology can teach us about Parfit’s theory. (shrink)

This chapter discusses some concerns regarding the effects of enhancement technologies on autonomy and authenticity, insofar as authenticity relates to autonomy. As a preliminary, it describes how enhancement and autonomy should be understood in this context along with some examples of enhancement. The chapter moves on to explain why enhancement can promote autonomy. Three types of concerns regarding the effect of enhancement technologies on autonomy are raised: (i) that medical technologies should not be used to enhance autonomy, since this is (...) not the proper use of such technologies; (ii) that some enhancement technologies are inimical to our authenticity; and (iii) that the widespread use of some enhancement technologies have negative overall consequences on people's autonomy. Different kinds of enhancements typically arouse different kinds of concerns as regards autonomy. These include cognitive, mood, physical, and aesthetic enhancement. (shrink)

Genetic determinism can be described as the attribution of the formation of traits to genes, where genes are ascribed more causal power than what scientific consensus suggests. Belief in genetic determinism is an educational problem because it contradicts scientific knowledge, and is a societal problem because it has the potential to foster intolerant attitudes such as racism and prejudice against sexual orientation. In this article, we begin by investigating the very nature of belief in genetic determinism. Then, we investigate whether (...) knowledge of genetics and genomics is associated with beliefs in genetic determinism. Finally, we explore the extent to which social factors such as gender, education, and religiosity are associated with genetic determinism. Methodologically, we gathered and analyzed data on beliefs in genetic determinism, knowledge of genetics and genomics, and social variables using the “Public Understanding and Attitudes towards Genetics and Genomics” instrument. Our analyses of PUGGS responses from a sample of Brazilian university freshmen undergraduates indicated that belief in genetic determinism was best characterized as a construct built up by two dimensions or belief systems: beliefs concerning social traits and beliefs concerning biological traits; levels of belief in genetic determination of social traits were low, which contradicts prior work; associations between knowledge of genetics and genomics and levels of belief in genetic determinism were low; and social factors such as age and religiosity had stronger associations with beliefs in genetic determinism than knowledge. Although our study design precludes causal inferences, our results raise questions about whether enhancing genetic literacy will decrease or prevent beliefs in genetic determinism. (shrink)

Two experiments with undergraduates as subjects were carried out with the aim of replicating and extending previous results showing that the implication of the behavioral life-cycle hypothesis (H. M. Shefrin & R. H. Thaler, 1988) that people classify assets in different mental accounts (current income, current assets, and future income) may explain how consumption choices are influenced by temporary income changes. In both experiments subjects made fictitious choices between paying for a good in cash or according to a more expensive (...) installment plan after they had received an income which was either less, the same, or larger than usual. In Experiment 1 subjects were supposed to have savings so that the total assets were equal, whereas in Experiment 2 the total assets varied. The results of both experiments supported the role of mental accounts in demonstrating that subjects were unwilling to pay in cash after an income decrease even though they had access to saved money. Thus, in effect they chose to pay more for the good than they had to. Indicating a need for further refinement of the concept of mental account, choices to pay in cash after an income decrease tended to be more frequent when the consumption and savings motives were compatible than when they were incompatible. Furthermore, increasing the total assets made subjects more willing to pay in cash after an income decrease. (shrink)

We examine the extent to which multiple social identities are associated with enhanced health and well-being in retirement because they provide a basis for giving and receiving social support. Results from a cross-sectional study show that retirees ( N = 171) who had multiple social identities following (but not prior to) retirement report being (a) more satisfied with retirement, (b) in better health, and (c) more satisfied with life in general. Furthermore, mediation analyses revealed an indirect path from multiple social (...) identities to greater satisfaction with retirement and better health through greater provision, but not receipt, of social support to others. These findings are the first to point to the value of multiple group membership post-retirement as a basis for increased opportunities to give meaningful support to others. We discuss the theoretical and practical implications for the management of multiple identities in the process of significant life transitions such as retirement. (shrink)
